Welcome to AAWKI (“we,” “our,” “us”). These Terms and Conditions (“Terms”) govern your use of our website, services, and platform (collectively, the “Services”). By accessing or using the AAWKI website, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.
AAWKI is an online platform based in New York, promoting and selling exceptional art through private sales, e-commerce, and retail. We offer works curated by AAWKI as well as those uploaded and sold directly by independent artists (“Artists”).
By using our Services, you represent that you are at least 18 years old and legally capable of entering into binding agreements. If you are under 18, you may only use the Services with the consent and supervision of a parent or legal guardian.
To access certain features of AAWKI, you may be required to create an account. You are responsible for maintaining the confidentiality of your login information and for all activity under your account. AAWKI reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or harmful activity.
Artists may upload, display, and sell their original works through our platform. By submitting content, Artists agree that:
They are the creator and rightful owner of the work.
They retain all intellectual property rights to their art.
They grant AAWKI a non-exclusive, royalty-free, worldwide license to display, promote, and sell their work through our Services.
They are responsible for ensuring their content does not infringe any third-party rights or violate any laws.
AAWKI reserves the right to review, edit, or remove any listing that violates our policies or standards.
All prices are listed in U.S. dollars unless stated otherwise. Payments are processed securely through Stripe. By making a purchase, you agree to provide accurate billing and payment information.
AAWKI is not responsible for delays, failed transactions, or issues arising from third-party payment processors.
We aim to process and ship all orders promptly. Delivery times may vary depending on the destination and shipping method. AAWKI is not liable for delays caused by carriers or external circumstances beyond our control.
Due to the nature of art sales, all sales are final unless the product arrives damaged or incorrect. In such cases, please contact us at info@aawki.com within 7 business days of delivery. We may request photographic proof of damage before issuing a replacement or refund.
8. Intellectual Property
All content on the AAWKI website—including text, images, graphics, logos, and designs—is owned by or licensed to AAWKI and protected under applicable copyright and trademark laws. You may not reproduce, distribute, or modify any part of the website without prior written consent from AAWKI or the respective artist.
Artists retain full ownership of their artworks. AAWKI’s license to display and sell works ends when the listing is removed or the artist account is terminated.
You agree not to:
Use the Services for unlawful or fraudulent purposes.
Copy, distribute, or exploit the works or platform content without authorization.
Interfere with website functionality or security.
Impersonate AAWKI, its employees, or other users.
Violation of these terms may result in account termination and potential legal action.
AAWKI and its affiliates shall not be liable for any indirect, incidental, or consequential damages resulting from your use of our Services, including but not limited to loss of data, profits, or goodwill.
Our total liability to you for any claim related to the Services shall not exceed the total amount paid by you to AAWKI within the past six months.
You agree to indemnify and hold harmless AAWKI, its officers, employees, and partners from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Services.
AAWKI reserves the right to update or modify these Terms at any time without prior notice. Updates will be effective immediately upon posting on our website. Your continued use of the Services constitutes acceptance of the revised Terms.
These Terms and any disputes arising under them shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
